1. Who We Are
CFX Solutions LLC ("CFX Solutions," "we," "our," or "us") provides freight factoring, fuel, payment and related services to trucking companies. Our office is at 640 Taylor St. Suite 1200, Fort Worth, TX 76102.
This Privacy Policy explains how we collect, use, share and protect personal information when you visit cfxfactor.com; when you use our intake form, credit application, partner pages, proposals or e-signature pages at crm.cfxfactor.com; and when you deal with us by phone, text message or email. It covers information about the owners, officers, drivers and other contacts of the businesses we work with.
2. Information We Collect
Depending on how you deal with us, we collect:
- Contact and business details: your name, phone number, email address, company name, USDOT and MC numbers, business address, fleet size and equipment type, current factoring company, referral code, and anything else you tell us about your business.
- Application and account information: identity and financial details you give us when you apply or become a client, such as owners' names, home addresses, dates of birth, Social Security numbers and driver's licenses; your business's tax ID and bank account details; the documents and agreements you upload or sign; invoices and payments; fuel purchase details if you use our fuel program; and the results of the credit, lien and carrier-verification checks we run.
- Communications: emails, texts and notes of our calls with you, whether you open our emails and click their links, and records of your consent to receive texts.
- Referral partner information: if you join our partner program, your company and contact details, partner type, audience size and marketing consent.
- Device and usage information: IP address, browser and device type, pages visited, the referring site and campaign tags, and the time of your visit, including the IP address and browser used to start an intake form or partner sign-up.
Sensitive information
Some of this information is sensitive: Social Security numbers, driver's license numbers, dates of birth, bank account numbers and credit report information. We collect it to evaluate and provide our services and use it only for the purposes described in this policy. Section 5 explains how we protect Social Security numbers.
3. Where We Get Information
We get information from you and from public records, such as FMCSA and USDOT registrations and lien filings. We also get it from credit reporting agencies and the IRS when you authorize it, and from carrier-verification and industry watch-list services, referral partners, our factoring and fuel platforms, and your customers (account debtors).
4. How We Use Information
We use personal information to:
- Respond to your questions and requests.
- Evaluate your application and verify identity and operating authority.
- Obtain the credit reports you authorize and check lien filings.
- Provide and service your account, including funding, payments, and our fuel and payment programs.
- Notify your customers that invoices have been assigned to us, and verify and collect payment on them.
- Run our referral partner program.
- Market our services, including by email to motor carriers listed in public FMCSA records. You can opt out at any time (see Section 8).
- Understand how our website is used and improve it.
- Keep our systems, customers and business secure, and prevent fraud.
- Comply with the law, enforce our agreements, and establish or defend legal claims.
AI tools
Our staff use AI tools from service providers to help with their work, and people make every decision about applications, pricing and accounts.
5. How We Protect Social Security Numbers
This section explains how we collect, use, protect, give access to and dispose of Social Security numbers (SSNs).
Collection
Our online application asks for the SSN of each owner of a business that applies. Owners may also give their SSN on IRS forms they sign when they apply, such as Form W-9 and Form 8821.
Use
We use SSNs to verify identity, obtain the credit reports you authorize, prevent fraud, process IRS forms and meet our legal and tax obligations. We do not sell SSNs or display them publicly.
Protection
To protect their confidentiality, SSNs are encrypted in transit. SSNs entered in our application are encrypted again when stored and shown masked, and signed forms and uploaded documents are kept in encrypted, private storage.
Access
Only staff given that permission can reveal a full SSN entered in our online application, and our system records each reveal. Signed tax forms that contain an SSN and the credit reports we obtain can be opened by the staff who work on applications and client accounts. We disclose SSNs only to the recipients in Section 6 that need them for the purposes above, such as credit reporting agencies, the IRS, and our e-signature and hosting providers.
Disposal
We keep SSNs as Section 10 describes. When we dispose of a record that contains an SSN, we delete it from our systems and destroy any paper copy, so that the SSN cannot be read or reconstructed.
6. How We Share Information
We share personal information, for the purposes in Section 4, with:
- Service providers that run our business for us: hosting and data storage, e-signature, email delivery and outreach, AI tools, error monitoring, address lookup, analytics and cookie consent.
- Our factoring, fuel-card and payment platforms, to run your account and the services you sign up for.
- Credit reporting agencies and the IRS, to get the credit reports and tax information you authorize.
- The referral partner who referred you, who can see your application's status but not your application details or documents.
- Your customers (account debtors), when we buy your invoices and collect payment.
- Professional advisers, such as our lawyers, accountants, auditors and insurers.
- Courts, regulators or law enforcement when the law requires it, or to protect our rights and others' safety.
- A buyer or successor, if CFX is merged or sold.
- Anyone else, with your consent or at your direction.
Mobile information, including your text-message opt-in, will not be shared with third parties or affiliates for marketing or promotional purposes.
7. Cookies and Analytics
Our website uses cookies, which are small files stored on your device, and similar technologies. One cookie remembers your cookie choices. We also use Google Analytics, through Google Tag Manager, which sets cookies to help us understand how visitors find and use our website.
We do not use advertising cookies or pixels. Google, through Google Analytics, and our cookie consent service collect information about your use of our website, and Google may connect it with information it collects about your activity on other websites over time, as described in its privacy policy (policies.google.com/privacy). Section 8 explains how to turn analytics cookies off.
Our website does not respond to Do Not Track signals, because there is no common standard for them. We do honor Global Privacy Control, as described in Section 8.
8. Your Privacy Choices
We do not sell personal information and do not share it for cross-context behavioral advertising, and we have not done so in the past 12 months.
To turn off analytics cookies, block or delete cookies in your browser settings, or install the Google Analytics Opt-out Browser Add-on from tools.google.com/dlpage/gaoptout. Where our cookie notice is shown, you can also use the "Cookie Preferences" link at the bottom of any page. With analytics cookies off, Google Analytics may still receive basic signals without cookie identifiers, such as the fact that a page was viewed.
If you are in the United States and your browser sends a Global Privacy Control (GPC) signal, our website treats it as a request to opt out and turns off analytics cookies for that browser.
To stop marketing emails, follow the opt-out instructions in the email; we will still send you messages about your application or account. To stop all text messages from us, reply STOP to any of them (see Section 9).
You do not need cookies to opt out or to make any privacy request. Email info@cfxfactor.com or call (888) 591-0864 to opt out of marketing, to ask us to stop calling or texting you, or to make any of the requests in Section 13.
9. Text Messages (SMS)
CFX Solutions sends text messages only to people who have agreed to receive them, for example by checking the box on our intake form. Agreeing to receive text messages is not a condition of applying for or buying any service.
Depending on what you agreed to, our texts may be about your inquiry, application or account, or may be occasional offers. Message frequency varies. Message and data rates may apply.
Reply STOP to any text message from us to stop all text messages from us. Reply HELP for help, or call us at (888) 591-0864.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
10. How Long We Keep Information
We keep personal information while we have a relationship with you and, after it ends, for as long as we need it for legal, tax, accounting, dispute-resolution and fraud-prevention reasons. How long depends on whether you only contacted us, applied or became a client, how long we need records of funding, payments, collections and agreements, and what the law requires. We keep records of opt-out requests so that we can keep honoring them, and you can ask us to delete personal information we are not required to keep (see Section 13).
11. Data Security
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit and in storage and access controls on the most sensitive fields. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
12. Children
Our website and services are for businesses, not children, and we do not knowingly collect personal information from anyone under 16.
13. Your Rights
Depending on where you live, you may have the right to access, correct or delete your personal information, or to opt out of marketing. To make a request, email info@cfxfactor.com or call (888) 591-0864. We may verify your identity before we act on it. We aim to respond within 45 days and will tell you if we need more time, and if we decline your request you can appeal by replying to our decision. We will not discriminate against you for using these rights.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post any changes on this page and update the effective date above. If we make a material change to how we use personal information, we will tell you more prominently, for example with a notice on our website or by email, before it takes effect.
